Jail for the STUPID - A New Lawsuit and a New Pile of Morons

Professor Bainbridge among other blawgs is excellent for providing these jewels of modern society.
A complaint filed with a California court this week alleged that Apple'’s music players were "“inherently defective in design"” and "“not adorned with adequate warnings regarding the likelihood of hearing loss".
and
"“Millions of consumers have had their hearing put at risk by Apple'’s conduct,"” the complaint said.
and
In addition to unspecified damages, this week'’s complaint sought to force Apple to upgrade its iPod software to limit the amount of sound the music players can produce.
Ok, so let me get this straight. You don't control the volume, so you play the music so loud that it hurts. Then it's Apple's fault because they made a device that allowed you a choice of how loud to play the music. And more of those warning labels must be required to detail what could be dangerous to people who are too stupid to be careful.

Here's another perfect example of a case where anyone who accepts money from this law suit should be tatooed on the forehead with a big, idiot label. Then they get put in a little padded cell until they can prove that they are capable of living responsibly on their own without having every product pre-emptively designed so that they can't hurt themselves.

No reason for tort reform in this country though, is there?

Every time I read about one of these stupid damned lawsuits... Would it really be such a bad thing to have some kind of an intelligence test for voting, really?
