Before the SCOTUS is Georgia v. Randolph. The topic concerns permission to enter a residence when one spouse allows entry and the other forbids access.
I would have thought this would be a simple matter. Like most things, the most restrictive restraint should be that which is followed. If one person with control of a dwelling objects, that is all that should be required.
